What a trademark protects

A trademark is a word, name, logo, slogan, shape or combination that tells customers who is behind a product or service. Registering it under the Trade Marks Act, 1999 gives you the exclusive right to use the mark for your goods or services and to act against copycats. Registered marks can use the ® symbol, while the ™ symbol can be used even before registration.

Why register

  • Exclusive legal right over your brand name and logo
  • Ability to take action against infringement
  • Builds trust and brand value
  • Makes it easier to license, franchise or sell your brand
  • Prevents others from registering a confusingly similar mark

Can be registered

  • Brand and business names
  • Logos and device marks
  • Slogans and taglines
  • Letters, numbers and shapes
  • Sound and colour combinations in some cases

Documents required

  • Name and address of the applicant
  • Identity proof and business proof, such as incorporation certificate or Udyam registration
  • Logo or brand name in the required format
  • List of goods or services and the class
  • Date of first use, if the brand is already in use with proof
  • Power of attorney signed in favour of the agent

Choose the right class

  • Marks are filed in classes of goods and services
  • One application covers one class, and you may need several
  • Choosing the wrong class can leave your brand unprotected

How registration works

  1. Trademark searchWe check the register for identical or similar marks before you spend money.
  2. File the applicationThe application is filed online with the class and details of use.
  3. ExaminationThe registry examines the mark and may raise objections, which we reply to.
  4. PublicationThe mark is published in the Trade Marks Journal so others can oppose it.
  5. Opposition periodThird parties get a window to oppose. We handle replies if needed.
  6. RegistrationOnce clear, the registration certificate is issued.
Fees, timelines and rules are set by the IP offices and change from time to time. We confirm the current position before filing.

Validity and renewal

Common questions

Can I register a brand name that is already in use?

Possibly, if it is not identical or similar to an existing mark. A search tells you the risk.

Does a company registration give me trademark rights?

No. Registering a company name and registering a trademark are different things.

When can I use the ® symbol?

Only after the mark is registered. Until then, use ™.

How long does it take?

It depends on objections and oppositions. We share a realistic timeline after the search.
