What a patent protects

A patent gives the inventor exclusive rights to make, use, sell or import an invention for a limited time, in return for disclosing how it works. In India patents are granted under the Patents Act, 1970.

An invention should be

  • New, meaning not already public anywhere in the world
  • Inventive, meaning not obvious to an expert in the field
  • Capable of industrial application
  • Not excluded under the Patents Act, such as mere discoveries or certain computer programs and business methods

Who files

  • Individual inventors and researchers
  • Startups with new technology
  • Universities and institutes
  • Manufacturers and product companies

What we need from you

How the process works

  1. Prior-art searchWe check whether your idea is already disclosed before you spend on filing.
  2. Provisional filing (optional)Secures an early date while you finish developing the invention.
  3. Complete specificationA full technical description and claims are filed, usually within 12 months of a provisional.
  4. PublicationApplications are generally published after about 18 months, unless early publication is requested.
  5. Request for examinationYou must request examination within the prescribed period.
  6. Office action and grantWe reply to objections, and the patent is granted if the examiner is satisfied.
Fees, timelines and rules are set by the IP offices and change from time to time. We confirm the current position before filing.

Common questions

Can I patent software?

Computer programs as such are excluded, but inventions with a technical effect may qualify. Each case is assessed individually.

Should I tell others about my idea first?

Avoid public disclosure before filing, since it can destroy novelty.

How long does a patent take?

It usually takes years, depending on examination and objections.

What is the difference between provisional and complete?

A provisional gives an early filing date, while a complete specification describes the invention fully and claims protection.
