What a registered design protects

An industrial design protects the visual appearance of a product, such as its shape, configuration, pattern or ornamentation, as long as it is applied to an article. It does not protect how the product works. Designs are registered under the Designs Act, 2000.

What qualifies

  • Features of shape, configuration, pattern or ornament
  • New and original, not published anywhere before filing
  • Applied to a physical article by an industrial process
  • Not a trademark, a mere mechanical function or a prohibited design

Examples

  • A bottle shape or packaging design
  • The pattern on a fabric or tile
  • The outline of a lamp, chair or gadget
  • Decorative elements on a product

Common questions

Design or trademark: which one do I need?

A design protects how a product looks. A trademark protects the brand identifying it. Many businesses use both.

Can I register a design after launching the product?

Publication before filing can make the design ineligible, so file first.

Does it protect the function of the product?

No. For functional inventions, a patent may be the right tool.
